Tier 1 (Entrepreneur) Visa
The Tier 1 (Entrepreneur) visa was for individuals who wanted to set up or run a business in the UK, based on a substantial financial investment and active involvement in business management. The route is now closed to new applicants but remains open to those already holding leave under this category who wish to apply for settlement (Indefinite Leave to Remain). Dependants can apply to settle at the same time.
Overview
The Tier 1 (Entrepreneur) visa route closed to new applications on 29 March 2019. Extensions were permitted until 5 April 2023. However, individuals who already hold valid leave under this route may still apply for Indefinite Leave to Remain (ILR).
Applicants must demonstrate continued business activity, genuine engagement in their UK business, and that they have created employment in accordance with the Immigration Rules.
Who Can Apply?
You can apply for settlement under the Tier 1 (Entrepreneur) visa if you:
- Currently hold valid leave under this visa category
- Have spent the required continuous residence period (usually 5 years)
- Have created at least two full-time jobs for settled workers, each lasting at least 12 months
- Have genuinely operated one or more UK businesses during your stay
- Meet the English language and Life in the UK test requirements
- Have not had excessive absences or immigration breaches
Accelerated ILR after 3 years is still legally available if you:
- Created at least 10 full-time jobs for settled workers, or
- Generated at least £5 million in business income over a 3-year period
However, as the route is fully closed and most leave is expiring by 2025, standard 5-year settlement remains the more common route.
Can I Bring Family?
Yes. If your dependants have lived in the UK with you under this route, they can apply for settlement at the same time, provided they meet the eligibility requirements.
